1.What Does This Privacy Policy Mean?

1.1 In this Privacy Policy (hereinafter, the “Privacy Policy”), we provide information on how UAB “Sėkmingi” (hereinafter, the “Company”) processes your personal data obtained: when the Company provides services and sells goods to clients or receives services and purchases goods (when the other contractual party is a natural person); in the course of direct marketing activities; in candidate selection; to ensure the protection of confidential information and business continuity; to fulfill contracts established between the Company and corporate partners; to defend legitimate interests in the event of disputes or violations; when you visit the Company’s website or social media accounts; in response to inquiries; and through video surveillance. All individuals whose data is processed by the Company are referred to as “Data Subjects” below.

2. About the Company

2.1 The Company refers to UAB “Sėkmingi,” legal entity code 304754709, with its registered office at Rąžės g. 35-2, Kaunas, Lithuania. 3. What Are Personal Data?

3.1 Personal data are any information collected by the Company about the Data Subject that can be used to identify the Data Subject and is stored electronically or otherwise.

3.2 Personal data includes any information about the Data Subject such as name, surname, and address collected by the Company for purposes specified in this Privacy Policy or in a separate Data Subject consent or agreement with the Company.

5. Direct Marketing

5.1 For individuals over 14 who have provided their contact information and expressed interest in receiving information about the Company’s products and/or services, we will send offers, newsletters, and other promotional materials electronically (e.g., by email).

5.2 For direct marketing purposes, the Company will process your email address (a mandatory field without which we cannot send you marketing messages). Your data will be processed for direct marketing purposes for three years from the date of consent.

5.3 If you have purchased services from the Company and have not objected to receiving direct marketing messages (e.g., by checking an opt-out box in the direct marketing consent form or notifying us via the email provided in the Policy), we will send you emails or SMS regarding services similar to those you purchased. In such cases, your data will be processed for direct marketing purposes for three years after the last purchase.

5.4 You have the right to object or withdraw from receiving direct marketing messages by contacting us at the email provided in Section 2.

6. Candidate Selection

6.1 We collect and process your personal data (name, surname, desired position, work experience including previous employers, job titles, references, education, and any other information specified in your CV, application, cover letter, or other provided information) for recruitment purposes based on your consent, which you grant by submitting your CV and/or cover letter to the Company. If you do not provide your CV and/or cover letter, we will be unable to assess your suitability for the advertised position.

6.2 If you do not provide separate consent for processing your personal data, we will delete and/or destroy your personal data within three days after signing a contract with the selected candidate or deciding to close the recruitment process, except when separate consent for data retention is granted for a specified period as outlined in the consent agreement.

6.3 If, under applicable law, we are required to verify your health status before employment, we will process health data to confirm your suitability based on legal obligation.

6.4 With your consent, we will retain your data for the period specified in the consent.

6.5 Based on our legitimate interest, we may process data on individuals referenced by the candidate (name, surname, email, phone number, and information provided by the reference) for recruitment purposes. In this case, our legitimate interest is to select a suitable candidate for the position. This data will be destroyed at the end of the recruitment process.

6.6 We may receive your data directly from you, from online platforms where you apply for our job openings, or from recruitment agencies.

7. Protection of the Company’s Confidential Information and Business Continuity

To ensure the protection of the Company’s confidential information and to maintain business continuity as part of our legitimate interest, the Company may review its employees’ correspondence with contractors. For these purposes, the Company processes personal data, including the email addresses, content of information on electronic work tools, and dates of correspondence, from employees and individuals who send or receive messages from employees. This data is retained for four years.

8. Fulfillment of Contracts with Corporate Partners

To ensure the fulfillment of the Company’s contracts established with corporate partners (legal entities) as part of our legitimate interest, the Company processes personal data of these entities’ employees, such as name, surname, email address, phone number, and correspondence content. Data related to contract fulfillment is retained for ten years after the contract ends.

9. Defense of Legitimate Interests in Cases of Disputes, Theft, and Other Criminal or Administrative Offenses

To defend its rights based on its legitimate interest, the Company processes personal data of individuals involved in or suspected of criminal offenses, civil disputes, thefts, or administrative violations, as well as other parties involved in the case. This data includes names, surnames, personal identification numbers, case details, other case-related information, and publicly available information. Data may be shared with insurance companies, law enforcement agencies, or bailiffs engaged in debt collection. This data is destroyed three years after the case’s final resolution and full satisfaction of the Company’s claims (if any awarded amounts are collected).

10.1 There are several ways to contact the Company: by phone, email, or by filling out an online inquiry form. We receive, review, and respond to all messages directly. If you contact us, we may process the data you provide, including name, company, phone number, email, project description, and any attached project information.

10.2 Such data will be processed based on your consent to respond to your questions and review your suggestions. If you do not provide your contact information, it will not be possible to reach you.

10.3 Correspondence is retained for one year from the receipt of the message, except in cases where other retention periods are specified in this Privacy Policy or required by law.

10.4 All personal data you provide while communicating with us is used solely for the purposes stated above, to review messages, and to manage communication flows. We commit not to use your personal data in any media channels in a way that could identify you without your explicit consent.

13. Newsletter
